Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PestControlCheck website, directory, and related services (collectively, the "Service"). PestControlCheck is operated from Austin, Texas. By accessing or using the Service, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing, browsing, or using PestControlCheck in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

2. Use of the Directory

PestControlCheck is a free-to-use online directory of pest control companies across the United States. Listing data is sourced from public records, verified sources, and business owner submissions. While we strive to provide accurate and current information, we make no guarantee of the accuracy, completeness, or timeliness of any data displayed on the Service.

Users are solely responsible for independently verifying the credentials, licensing status, insurance coverage, and qualifications of any pest control company before engaging their services. PestControlCheck does not perform background checks, verify licensing in real time, or certify the competence of any listed business.

3. Business Listings

Business listings in the PestControlCheck directory are compiled from publicly available sources, including but not limited to Google Maps, state licensing boards, and business registrations. Inclusion in the directory does not constitute an endorsement, recommendation, or guarantee of any business.

Business owners may claim and update their listings by contacting us. We make reasonable efforts to keep listing data current but are not responsible for outdated, incomplete, or inaccurate information. We reserve the right to remove or modify any listing at our sole discretion, including listings for businesses that are permanently closed, fraudulent, or in violation of these Terms.

4. Sponsored Listings and Subscriptions

PestControlCheck offers paid sponsored listing subscriptions that provide enhanced visibility in directory search results. Sponsored listings are clearly labeled as such. Sponsorship does not affect which companies are included in the directory, only their placement and visual prominence.

4.1 Subscription Tiers and Pricing

Sponsored listing subscriptions are available in three tiers:

  • Basic: $99 per month
  • Premium: $199 per month
  • Elite: $299 per month

Annual plans are also available at a discounted rate. Current pricing and tier details are displayed on the Pricing page. All prices are in United States Dollars (USD).

4.2 Automatic Renewal

All subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date. By subscribing, you authorize PestControlCheck and its payment processor (PayPal) to charge your selected payment method at the then-current subscription rate on each renewal date. You will be charged the same amount as your initial subscription unless we have provided you with at least 30 days' written notice of a price change.

4.3 Cancellation

You may cancel your subscription at any time through your PayPal account dashboard by managing your recurring payments settings. Cancellation takes effect at the end of the current billing period. After cancellation, your sponsored listing benefits will remain active until the end of the period you have already paid for. No action is required on our end to process a cancellation initiated through PayPal.

4.4 Refund Policy

No refunds are issued for the current billing period. If you cancel your subscription, you will not receive a refund for any remaining unused time in the current billing cycle. Your sponsored listing will remain active through the end of the paid period. We do not offer prorated refunds.

4.5 Price Changes

We reserve the right to change subscription pricing at any time. If we change pricing, we will provide existing subscribers with at least 30 days' written notice (via email) before the new price takes effect. Existing subscribers will retain their current rate until their next renewal date following the notice period. Continued use of the subscription after a price change constitutes acceptance of the new pricing.

4.6 Payment Processing

All payments are processed securely through PayPal. PestControlCheck does not directly collect, store, or have access to your credit card or bank account information. Your payment is subject to PayPal's terms of service and privacy policy. By subscribing, you agree to PayPal's terms in addition to these Terms.

4.7 Failed Payments

If a scheduled payment fails, PayPal will attempt to process the charge again according to its retry schedule. If payment cannot be collected after three (3) failed attempts, your subscription will be suspended and your sponsored listing benefits will be removed. To restore your subscription, you must update your payment information and resubscribe.

5. Lead Generation and Quote Requests

PestControlCheck allows users to submit quote requests and contact forms to pest control companies listed in the directory. When you submit a quote request, the information you provide (including your name, contact details, and service description) will be shared with the pest control company or companies you have selected.

PestControlCheck acts solely as an intermediary to facilitate communication between users and pest control companies. We are not a party to any transaction, agreement, or contract between you and any pest control company. We do not guarantee the quality, safety, timeliness, legality, or pricing of any services provided by pest control companies, and we assume no liability for any disputes arising between users and service providers.

6. User Conduct

When using PestControlCheck, you agree not to:

  • Submit false, misleading, or fraudulent information through any form on the Service
  • Use automated tools, bots, scrapers, or other means to collect data from the Service without our prior written permission
  • Harass, threaten, or defame any business or individual listed in the directory
  • Submit fraudulent claim requests or impersonate a business you do not own or represent
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Reproduce, distribute, or create derivative works from the Service content without permission

Violation of these rules may result in immediate suspension or termination of your access to the Service without notice.

7. Intellectual Property

All content, design, graphics, layout, code, and other materials on PestControlCheck (collectively, "Site Content") are the property of PestControlCheck or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

Business data sourced from publicly available records (such as company names, addresses, phone numbers, and licensing information) is not proprietary to PestControlCheck. However, the compilation, arrangement, and presentation of such data on this Service is protected intellectual property.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Site Content without our prior written consent, except for personal, non-commercial use such as viewing listings and submitting quote requests.

8. Limitation of Liability

PestControlCheck is a directory and marketplace platform. We are not a pest control service provider, contractor, or licensed exterminator. We do not perform, supervise, or guarantee any pest control work.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PESTCONTROLCHECK, ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT OF FEES YOU HAVE PAID TO PESTCONTROLCHECK IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES, OUR MAXIMUM LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

We are not responsible for the quality, safety, legality, or availability of services provided by any pest control company listed in the directory. We do not verify the accuracy of reviews, ratings, or other user-submitted content.

9. Indemnification

You agree to indemnify, defend, and hold harmless PestControlCheck, its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any information you submit through the Service, including quote requests, reviews, or claim requests; or (e) any dispute between you and a pest control company contacted through the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to PestControlCheck or other users.

We may remove business listings at our sole discretion, including listings for businesses that are permanently closed, fraudulent, unlicensed, or otherwise in violation of these Terms or applicable law.

Sponsored listing subscriptions may be terminated by PestControlCheck for violations of these Terms. In the event we terminate a subscription due to your violation, no refund will be issued. If we terminate a subscription without cause, we will issue a prorated refund for the unused portion of the current billing period.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.

Before filing any legal claim, you agree to attempt to resolve the dispute informally by sending a written notice describing your claim to [email protected]. Both parties agree to negotiate in good faith for at least thirty (30) days before initiating formal legal proceedings.

12. Modifications to Terms

We reserve the right to modify or update these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide additional notice (such as via email to active subscribers). Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
